• Where processing is mandatory for the establishment, exercise, or protection of a legal right;

Under these circumstances, Viasu may process all of your non-sensitive personal data without obtaining your prior consent.
Processing of Sensitive Personal Data
Your sensitive personal data—such as information related to race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, appearance and dress, membership in associations, foundations or trade unions, criminal convictions and security measures, as well as biometric and genetic data—may only be processed under circumstances explicitly stipulated by law. In processing such sensitive data, Viasu ensures that all necessary safeguards determined by the Personal Data Protection Board (KVKK Board) are implemented.
Sensitive personal data relating to health and sexual life may only be processed by persons or authorized institutions and organizations that are under a legal obligation to maintain confidentiality, and only for purposes such as the protection of public health, preventive medicine, medical diagnosis, treatment and care services, as well as for the planning and management of healthcare services and financing. Outside of these legal circumstances, this data will not be processed without your explicit consent.
Viasu undertakes to process all personal data in accordance with the law and principles of good faith; to ensure that it is accurate and kept up to date when necessary; to process data for specific, clear, and legitimate purposes; and to limit data processing to what is relevant, proportionate, and necessary for the intended purpose. Data will be stored only for the period stipulated in applicable legislation or as required by the purpose for which it is processed.

Additionally, the forms through which you submit data are protected with 128-bit SSL (Secure Socket Layer), an encrypted communication channel that safeguards your information during transmission.
Once the data reaches Viasu, it is stored in accordance with our security and confidentiality standards. To benefit from SSL protection, your internet browser must support SSL and the SSL options in your browser must be enabled.
Furthermore, we take all administrative measures we deem necessary to protect and maintain the security of your personal data. GENERAL INFORMATION
Your Rights
According to Article 11 of the Law No. 6698 on the Protection of Personal Data (“Law”), individuals defined as data subjects (hereinafter referred to as the “Applicant”) are granted the following rights:
• To learn whether their personal data is being processed (KVKK 11.1.a),
• If their personal data has been processed, to request information regarding such processing (KVKK 11.1.b),
• To learn the purpose of processing their personal data and whether it is being used in line with the stated purposes (KVKK 11.1.c),
• To know the third parties to whom personal data is transferred within the country or abroad (KVKK 11.1.ç),

Application Procedure
Pursuant to the Communiqué on the Principles and Procedures for Application to the Data Controller (Official Gazette dated 10/03/2018 and numbered 30356), your application must include:
• (a) Your name, surname, and signature,
• (b) For Turkish citizens, your Turkish ID number; for foreigners, your nationality, passport number, or if available, your foreign ID number,
• (c) Your residence or workplace address for notifications,
• (ç) If available, your e-mail address, telephone, and fax number for notification,
• (d) The subject of your request, and
• (e) Any relevant documents and information concerning your request must be attached to the application.
If you are submitting an application on behalf of someone else, you must include documents showing your authority to apply on their behalf (e.g., a guardianship order, parental authority document, or a notarized power of attorney clearly authorizing you to make this request under the Law).
You may use the Personal Data Application Form below for matters concerning your personal data. In order to eliminate legal risks arising from unlawful or unauthorized data sharing, and especially to ensure the security of your personal data, our Company reserves the right to request additional documents and information (such as a copy of your identity card or driver’s license) for identity and authority verification.
If the information you provide in the form is not accurate or up-to-date, or if the application is made without proper authorization, our Company will not be responsible for any claims arising from such incorrect or unauthorized applications.
Your applications submitted to us will be answered in writing and free of charge within thirty (30) days from the date your request reaches us, in accordance with Article 13(2) of the Law. However, if the response exceeds ten (10) pages, a processing fee (1 TRY per page) may be charged for each page beyond the tenth, as determined by the Board.
